利用規約 / Terms of Service

1. はじめに

本利用規約（以下「本規約」）は、abyo software 合同会社（以下「当社」）が提供する語学学習アプリケーション「TalkBuddy」（以下「本アプリ」）の利用条件を定めるものです。本アプリをご利用いただくことにより、本規約に同意したものとみなされます。

2. サービス内容

本アプリは、AIを活用した語学学習サービスを提供します。ユーザーはAIとの会話練習、ゲーム、フラッシュカード等の機能を利用できます。

3. 利用料金

• 本アプリは無料で利用を開始でき、一定回数のメッセージを無料で送信できます。
• 無料メッセージの上限を超えた場合、プレミアムプラン（月額サブスクリプション）への加入が必要です。
• 事前登録特典等のボーナスアイテムは、条件を満たしたユーザーに1回限り付与されます。
• サブスクリプションの料金・解約条件は、Google Playの定めに従います。

4. 禁止事項

ユーザーは以下の行為を行ってはなりません：

• 本アプリの不正利用、逆アセンブル、リバースエンジニアリング
• 他のユーザーまたは第三者の権利を侵害する行為
• 法令に違反する行為
• 本アプリのサーバーに過度な負荷をかける行為

5. 免責事項

• 本アプリのAI機能はGoogle LLC が提供するAIサービス（Gemini API）を利用しています。GoogleによるAIサービスの停止、変更、障害等が発生した場合、本アプリの一部または全部の機能が利用できなくなる可能性があります。当社はこれに起因する損害について一切の責任を負わず、サービスの継続的な提供を保証しません。
• AIの応答内容の正確性、完全性、有用性について当社は保証しません。学習の参考としてご利用ください。
• 本アプリの利用により生じたいかなる損害についても、当社は一切の責任を負いません。

6. 知的財産権

本アプリに関する知的財産権は当社に帰属します。ユーザーは、私的利用の範囲を超えて本アプリのコンテンツを複製、配布、改変することはできません。

7. サービスの変更・終了

当社は、事前の通知なく本アプリの内容を変更し、またはサービスを終了することができます。

8. 規約の変更

当社は必要に応じて本規約を変更できます。重要な変更がある場合はアプリ内でお知らせします。変更後に本アプリを利用した場合、変更後の規約に同意したものとみなします。

9. 準拠法・管轄

本規約は日本法に準拠し、本規約に関する紛争は東京地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Service ("Terms") govern your use of the language learning application "TalkBuddy" ("the App") provided by abyo software LLC ("we", "us"). By using the App, you agree to these Terms.

2. Service Description

The App provides AI-powered language learning services. Users can practice conversations with AI, play language games, use flashcards, and more.

3. Fees

• The App is free to start, with a limited number of free messages.
• Once the free message limit is reached, a Premium plan (monthly subscription) is required for continued use.
• Bonus items such as pre-registration rewards are granted once per eligible user.
• Subscription pricing and cancellation terms are governed by Google Play's policies.

4. Prohibited Activities

Users must not:

• Misuse the App, disassemble, or reverse-engineer it
• Infringe on the rights of other users or third parties
• Violate any applicable laws or regulations
• Place excessive load on the App's servers

5. Disclaimer

• The App's AI features rely on AI services (Gemini API) provided by Google LLC. If Google discontinues, modifies, or experiences outages in its AI services, some or all features of the App may become unavailable. We assume no liability for any damages arising from such events and do not guarantee the continuous availability of the service.
• We do not guarantee the accuracy, completeness, or usefulness of AI responses. Please use them as a learning reference only.
• We shall not be liable for any damages arising from the use of the App.

6. Intellectual Property

All intellectual property rights related to the App belong to us. Users may not reproduce, distribute, or modify the App's content beyond personal use.

7. Service Changes and Termination

We may change or discontinue the App at any time without prior notice.

8. Changes to Terms

We may update these Terms as needed. Significant changes will be communicated through the App. Continued use after changes constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court.
